2.2 The following people may enter the Weekly draw and Superdraw:
2.2.1 Any individual over the age of 18 years who resides in, or has a bank account in the UK. We reserve the right to require proof of identity and age.
2.2.2 On 1st September 2023 the minimum age of entry to the Lottery changed from 16 to 18 years. Any players that purchased entries to the Lottery before the date of this change and are aged 16 or 17, entries are still valid but they may not purchase any additional entries until they reach 18 years of age. Any persons who have entered the Lottery and are found to be under the minimum age as set out in our Terms & Conditions will automatically forfeit any prize.
2.3 The maximum number of weekly chances permitted for any individual is 6 for the Weekly draw plus 6 for the Superdraw.
2.4 All proceeds, after the deduction of legal prizes and expenses, shall be deemed as a donation to Demelza, registered charity no. 1039651.
2.5 Any application for entry into the Lottery may be rejected for any reason at the discretion of the Promoter.
2.6 Any Lottery entry may be terminated for any reason at the discretion of the Promoter.
2.7 The Promoter’s decision is final in any matter regarding the Lottery.
3.1 Each entry costs £1 per draw. Weekly draw player numbers are chosen at random and the supporter's unique Demelza Lottery membership number(s) are sent to them by post. Superdraw players may select four numbers between 1-39 or can have their four numbers selected by a random generator.
3.2 The member will be entered into the draw for which each subscription has been received in advance of the draw taking place. All advance payments received from the member will be held in account by Demelza Trading Ltd and credited upon receipt to the relevant amount of draws in advance.
3.3 Persons eligible may apply to play the Weekly draw and Superdraw online by Direct Debit or by completing an application form which will include the following information:
3.3.1 The applicant’s name, full address, telephone number, email address, confirmation of age over 18 years, and a completed Direct Debit mandate in favour of the draw. Alternatively, members may join by advance cheque for 13, 26, or 52 week membership by completing a paper application and sending this with the cheque directly to Demelza. Those wishing to join this way should initially contact the Lottery Office on 01795 845222.
3.4 The Direct Debit Guarantee applies to all Direct Debit arrangements. A copy of the Direct Debit Guarantee will be supplied to all members with their welcome pack. A member can cancel their Direct Debit at any time by notifying their bank or building society. Members should also notify Demelza of the cancellation. Any funds held in advance and not used in draws will be returned to a member upon request. No refund can be made in respect of subscriptions used in draws, unless as a result of our negligence.
3.5 Following acceptance of membership, Demelza will issue all members with a letter stating their membership number, which will be entered into all future draws for which that payment has been received. Members paying by Direct Debit will also receive a document detailing the Direct Debit instruction, including frequency and amount of payments amongst other relevant detail as required by the Direct Debit Guarantee.
3.6 It is the responsibility of the member to check that their details as held by us are correct, and to inform us of any errors in the information held. Members are also responsible for informing us of any future changes in their personal details, which we will update on our system within 3 working days of notification.
3.7 Members should note the date and frequency of payments and ensure that funds are available to cover Direct Debit payments when due. Demelza will not be liable for any charges incurred by the member, unless as a result of our negligence.
Note: If you pay by monthly direct debit the cost per Lottery Weekly draw chance will be £4.34 every calendar month, and an additional £4.34 if also playing the Superdraw. (For example - if you have one Weekly draw line and one Superdraw line, you will pay £8.68 every month.) The payments are calendar monthly, therefore twelve payments per year, totalling £52.00 for Weekly draw and £52.00 for the Superdraw.
4.1 The guaranteed prizes in our Weekly draw are: 1 x £1000 • 1 x £100 • 1 x £50 • 20 x £10 • 30 x £5
Total weekly prize money is £1,500 and amounts to £78,000 a year. From every £1 paid in the weekly draw, 63p of the Weekly draw proceeds are returned to the charity, and this far exceeds some others which may be as low as 20p in the pound. The remaining 37p a week covers prize money, running costs etc. Your chances of winning a prize in our Weekly draw on average are 1 in 440. Our net proceeds for Demelza average £1.2million a year, and is a major part of the funding required to provide Demelza's services.
4.2 The Superdraw is a rollover draw and does not give a weekly guaranteed prize. From every £1 paid each week in the weekly Superdraw, 70p is returned to Demelza. This leaves 30% of the weekly income from the draw that makes up the prize money for that week. If no winner is drawn, whatever the prize money was for that week is rolled over to the following week. This will continue until a winner is drawn or until the total reaches £25,000. At that point, a winner will be randomly chosen. The Superdraw provides an annual income to Demelza of circa £320,000 net and is accumulated into the main Lottery income of £1.2 million. The chances of winning in the Superdraw on average are 1 in 10,500.
4.3 In each draw the winning numbers will be selected by a computerised random number generator, approved by the Gambling Commission. The draw is operated by a designated officer of Demelza, the draw is witnessed and the results recorded.
4.4 Only members who have paid subscription to the relevant draw will be entered into the draw.
4.5 Members will not accrue any debt to the Lottery.
4.6 The prize structure is published on the Demelza website www.demelza.org.uk/lottery. Demelza has the right to change the prize structure at any time in line with the Gambling Act 2005.
4.7 Demelza reserves the right to withhold payment of a prize if we are not satisfied as to the validity or legality of a member, pending further investigation into each case.
4.8 Prize monies will be paid by cheque within 20 working days, subject to satisfaction of section 4.7, and sent to the winner’s registered address held by us following completion of the draw, with no requirement for winners to claim. Lottery results can be checked on the Demelza website www.demelza.org.uk/lottery-results.
4.9 Should Demelza be unable to pay a winning member because we do not hold their correct details, and after exhaustive investigation which may include communication with the member’s last known bank, we will after a period of 6 months, treat the winning monies as a donation to Demelza.
4.10 Winner’s details, in brief, may be used to promote new membership and/or further lotteries. If you win a prize in the Lottery we may also contact you (unless you have asked us not to) to ask if you would like to provide a photo and/or comment, in relation to being a Lottery winner, to help us to continue to promote our Lottery.
5.1 Demelza will not be liable to a member for any loss or damage suffered to a member arising from:
5.1.1 Any delays in payments received from members for entry into the Lottery.
5.1.2 Any delays or failure in the postal service or other delivery methods including emails used by Demelza or by members.
5.1.3 Any failures in the banking system used to transmit payments to or from Demelza.
6.1 Complaints pertaining to the lottery draw should in the first instance be sent by post to the address above, or by email to lottery@demelza.org.uk. We aim to respond to your complaint within 5 working days of its receipt. If we need time to investigate further, we will let you know we have received your complaint and how long it will take to resolve. In the first instance a complaint will be dealt with by the Manager of the Lottery Department. Should the complaint not be satisfied at this point it will be referred to the Chief Executive Officer of Demelza. If the complaint is still not satisfied at this point, the complaint will be referred to the Independent Betting Adjudication Service (IBAS) whose decision will be final.
