Demelza's Bubble Rush events

The Big Raffle

  • These booking terms and conditions apply to everyone who takes part in an event for Demelza, and those who attend as spectators. If you are registering on behalf of a group, you are accepting the terms and conditions on behalf of all group members.
  • These terms and conditions contain important information regarding participation, and upon entry you agree to and accept these terms and conditions.
  • There are additional terms and conditions for events such as Bubble Rush (please see Bubble Rush section).
  • Please note that these terms and conditions apply to Demelza organised events. If you are registering for a ‘Third Party’ event, you must adhere to any terms and conditions set by the company in question, please see the Third Party section for more information.
  • All participants taking part in this event do so at their own risk. In no event shall Demelza Hospice Care for Children be liable for any injuries, loss or damages whatsoever, including indirect, punitive, special, incidental or consequential losses connected with any aspect of this event.
  • Photographs will be taken of participants throughout the event which will be used on promotional materials. It is the participant’s responsibility to let staff know at registration if you do not want to appear in any such materials.
  • We reserve the right to ask participants and supporters to leave an event if they do not adherer to the terms and conditions and no refunds shall be given in these circumstances.

  • All entry fees to Demelza events, including Third Party events, are non-refundable and non-transferable.
  • Any registration fees contribute largely to the cost of staging the event and any administrative costs.
  • Children aged 16 or under are charged the child entry fee where applicable. Anyone aged 16 and over will be charged an adult entry fee.
  • If there are any differences to these ages, this will be specified on the event webpage in question.
  • Anyone under the age of 16 must be accompanied by a paying adult and will not be permitted to take part otherwise.
  • Any participant intending to cancel their place in the event shall inform Demelza as soon as reasonably practicable.

  • You are not permitted to use any of the sponsorship money that you raise in relation to the event to pay for your expenses. If you do not pass all of the money that you raise to Demelza you may be committing a criminal offence.
  • For many events, your registration fee covers the cost of the event. However, some events have higher costs which is why there is a set fundraising target in place.
  • If the event you are registering for has a minimum fundraising target, you agree to reach your fundraising target by the dates which are set out in your welcome information. 
  • Should you not be able to reach these amounts, Demelza reserves the right to cancel your place within the event, this may be due to the costs associated with your place in the event.
  • By fundraising for Demelza, you agree to return all sponsorship and donations to Demelza within six weeks of the event date.

  • You will either select your start time or it will be allocated to you. In either instance, this will be communicated to you.
  • Participants arriving late must abide by the instructions and decisions of the Event Manager or their representative. For health and safety reasons it is possible that late comers will not be permitted to take part.
  • We reserve the right to refuse entry to participants who try to take part in the wrong event or start time without prior approval.

  • Before registering for a Demelza event, you should be medically fit to participate, please seek medical advice if appropriate. You are required to inform the event organisers of any relevant medical conditions in the lead up to the event that might affect your performance during this event.
  • Your safety is of paramount importance. Please ensure that you follow all safety instructions and training procedures when participating in events.
  • Children aged 16 years and under must take part alongside a paying adult and be accompanied throughout the event. School and youth groups who take part must have adequate supervision. We reserve the right to prohibit individuals from taking part and will do so if participants under 18 have failed to provide evidence of parental consent.
  • No drugs, alcohol, illegal substances or other intoxicants of any kind are permitted to be used or present at a Demelza event.
  • Demelza opposes the promotion and use of tobacco in all forms. All Demelza events are non-smoking events which includes e-cigarettes.
  • Unless stated on the event webpage, dogs or any other animals or pets are not permitted at Demelza events.
  • By registering you are confirming that you are in good physical condition to participate in the event and will not arrive in ill health or unfit to take part.

  • Due to the nature of the event please do consider your choice in clothing. It is the participant’s responsibility to come suitably dressed for the event. The event organisers take no responsibility for clothing.
  • For cycling events, Demelza reserve the right to refuse entry to anyone who is not wearing a suitable cycling helmet.
  • By registering you are agreeing to carry any equipment needed for the event including water bottles or relevant event equipment that has been suggested.
  • You are responsible for acting sensibly and taking care to protect your own and other’s health and safety.

  • Should alterations need to be made to the event, we will give prior notice ahead of the event on the day of the event.
  • Demelza reserves the right to alter the start time of the event at any time.
  • Demelza reserves the right to update its terms and conditions at any stage. Terms and conditions can be viewed on our website at any time.
  • We reserve the right to reduce or alter events to accommodate any unexpected complications on the day that may have an impact on Demelza staff, volunteers, participants or spectators.

  • Some events require us to work with Third Party organisations which means that we must share your details with them.
  • For some events, you will be directed to their website to register, these events include but are not limited to;
    • Action Challenge’s Ultra Series, Machu Picchu, Paris to Demelza
  • For other events, you will register on Demelza’s website but we will share some of your details with the event organisers, these events include but are not limited to;
    • Royal Parks Half Marathon, London Marathon, Ride London
  • All Demelza event terms and conditions remain in place for Third Party Events, but you must also abide by any terms, conditions or rules set out by the Third Party Event organisers.

  • Demelza Hospice Care for Children reserves the right to cancel this event at any time. In the event of this happening, entry fees and sponsorship will be refunded in full.
  • If the event is cancelled because of circumstances of force majeure, the participant will not be entitled to any refund of the entry fee and/or compensation of other losses, such as travelling or accommodation expenses.

  • We deliver our events and any communications involved in a kind, professional and respectful way, we ask that our staff and volunteers are treated in the same manner. Demelza has a zero tolerance policy for its staff and volunteers at events to allow them to carry out their work without violence, abuse or harassment. 
  • Any verbal or physical behaviour which causes our staff or volunteers to feel uncomfortable, embarrassed or threatened, is unacceptable and will not be tolerated and you may be asked to leave the event.
  • In this instance, you will not be eligible for any refunds on registration fees or sponsorships.

  • The information you provide at registration will be shared only with that organisation, it will not be shared with any other organisation with the exception of Third Party events.
  • Demelza will use the contact details (address, phone and email address) that you have supplied, to send you information about this event and also events that Demelza may organise in the future.   • Where First Aid facilities are provided and you receive medical treatment, your details may be passed on to us for health and safety purposes and to fulfil our legal obligations (including those under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995). All accident details will be held on Demelza’s accident database in line with statutory requirements.

Entries

  • Each entry into the raffle costs £1.
  • Players may purchase up to 100 tickets at one time with a maximum of 300 tickets purchased in total.
  • We must have a valid email address to be able to process your entry. Without a valid email address, your entry may be void.
  • You must be 18 or over to enter the raffle and any player found to be underage will have their money refunded and their ticket numbers voided.
  • Entries must be bought by the entrant and cannot be bought on behalf of any other person.
  • You must be a resident in the United Kingdom to enter the raffle, we are not licenced to accept entries from Northern Ireland, the Channel Islands of the Isle of Man.
  • Credit card transactions are not accepted for the purchase of raffle tickets due to legislative changes by the Gambling Commission.
  • The Promotors will not be responsible for any entries that are lost, mislaid, damaged or delayed in transit for any reason as a result of any postal failures, equipment failure, technical malfunction, server, computer hardware or software failure of any kind.
  • All profits from the raffle will be used to fund the work of Demelza. A charity registered in England and Wales Registration Number 1039651.

 

Drawing the raffle

  • All entries into the raffle received by 19 January 2024 will be entered into the early bird draw to win a flying lesson.
  • The closing date for the raffle is midnight on 31 March 2024, all entries received after this date will be treated as a donation. The raffle will be drawn on 10 April 2024.
  • The draw is random and is drawn in front of two witnesses.
  • The first number drawn wins the first prize, the second drawn wins the second prize and so on until all prizes have been allocated.
  • The winners will be contacted by phone and letter within 14 days of the draw date.
  • Winners will have up to six months to claim their prize and Demelza will make reasonable attempts to contact prize winners during this time. Any prizes that remain unclaimed six months after the draw date will be forfeited and treated as a donation to Demelza.
  • All physical prizes must be collected from one of our three locations (Demelza Kent, Demelza South East London or Demelza East Sussex). If a prize cannot be collected, the winner must arrange a courier or alternative method of delivery. 
  • Demelza will list the winning names on our website following the draw.
  • We reserve the right to use the winner’s name for promotional purposes such as Mrs Wood from Kent.

 

Governance

  • The raffle is a draw operated and promoted by Demelza Trading Limited. (Registered address Demelza House, Rook Lane, Bobbing, Sittingbourne, Kent. ME9 8DZ), as a society lottery under the Gambling Act 2005.
  • Demelza Trading Limited’s Lottery is registered with the Gambling Commission as a Society Lottery https://www.gamblingcommission.gov.uk. We hold a licence to promote our raffle with the Gambling Commission.

Privacy

  • Demelza is committed to protecting your privacy. Data we collect from you is used lawfully in accordance with the UK and EU Data Privacy Regulations and will be used solely for the purpose of the raffle and the benefit of Demelza. Members have the right to access information we hold about them. To obtain such information a request in writing is required. Complaints

  • Complaints pertaining to the raffle should in the first instance be sent by post to the address above, or by email to lottery@demelza.org.uk. We aim to respond to your complaint within five working days of its receipt. If we need time to investigate further, we will let you know we have received your complaint and how long it will take to resolve. In the first instance a complaint will be dealt with by the Manager of the Lottery Department. Should the complaint not be satisfied at this point it will be referred to the Chief Executive Officer of Demelza. If the complaint is still not satisfied at this point, the complaint will be referred to the Independent Betting Adjudication Service (IBAS) whose decision will be final.

Please be aware that these are specific to Bubble Rush but they are in addition to our general terms and conditions. Please read these terms and conditions carefully and make sure that you understand them before completing your registration. You should understand that by submitting your registration form, you agree to be bound by these terms for yourself and all those you are registering.

 

General

  • These booking terms and conditions apply to everyone who takes part in Bubble Rush, and those who attend as spectators. The terms and conditions contain important information regarding participation, and upon entry you agree to and accept these terms and conditions.

 

I agree:

  • By taking part in The Bubble Rush I do so at my own risk. In no event shall Demelza Hospice Care for Children be liable for any injuries, loss or damages whatsoever, including indirect, punitive, special, incidental or consequential losses connected with any aspect of this event.
  • If necessary I should gain advice from my GP as to whether I am physically prepared to undertake the challenge.
  • Photographs will be taken of participants throughout the event which will be used on promotional materials. It is my responsibility to let staff know at registration I do not want to appear in any such materials.
  • Photographs may also be used for the brand of Bubble Rush. Demelza House Trading Ltd. which is a part of the charity is the owner of the Bubble Rush brand.

 

Registration

I understand:

  • The entry fee is non-refundable and non-transferable. Transfer of waves is also not permitted or guaranteed.
  • There is no minimum age limited however under 16’s must be accompanied by a responsible adult who has registered for the event.
  • Children aged 16 or under are charged a child’s ticket entry fee. Anyone aged 16 and over will be charged an adult ticket entry fee. Prices vary.
  • Children aged 3 and under will not receive a t-shirt. They will receive a medal and wristband. If you would like them to have a t-shirt please register them as a child aged 16 or under.
  • The registration fee contributes largely to the cost of staging Bubble Rush and includes your entry pack and fundraising materials.
  • The information you provide at registration will be shared only with that organisation, it will not be shared with any other organisation.

 

Sponsorship

I understand:

  • There is no minimum sponsorship requirement for this event however Demelza ask that all participants try to raise at least £15.
  • Sponsor forms are included in my welcome email and must be returned as soon as possible after the Bubble Rush, along with all the fantastic funds I have raised. There will also be a donation station at the event where you can drop these off on your way to the bubbles!
  • I agree to returning all sponsorship and donations received to Demelza within 6 weeks of the event date. By doing so, Demelza can make sure that we are on target to achieve best possible care to those who need it.
  • All funds raised by my participation in this event in support of Demelza are raised for the sole purpose and benefit of Demelza (registered charity no. 1039651) and those who receive the support from its services.

 

Safety

I understand:

  • Your safety is of paramount importance. Please ensure that you follow all safety instructions and training procedures when participating in events.
  • Children aged 16 years and under must take part alongside a paying adult and be accompanied throughout the event. School and youth groups who take part must have adequate supervision.
  • Upon running through the Bubble Stations, all children must be accompanied by an adult who will be responsible for their safety at this point. Small children may need to be lifted through some parts of the bubble stations, and we recommend they wear swimming goggles/sun glasses to protect their eyes.
  • The route is pushchair and wheelchair friendly, but if you have any concerns please contact the Demelza Events Team on bubblerush@demelza.org.uk
  • On no account is alcohol to be brought into the event site or consumed during the event. Demelza reserve the right to refuse entry to anyone under the influence of alcohol.
  • No dogs are allowed to participate in the Bubble Rush. This is in the best interest of your family pet and all those participating. The bubbles can affect dogs eyes as they have a different ph. level.
  • Bubble Rush involves a level of sustained physical activity. Participants make the decision to take part and must be satisfied that this activity is suitable for them as individuals. Neither Demelza nor its affiliates can be held accountable for aggravation to illness or injury sustained due to participation in this activity.
  • It is recommended that if you have any health concerns that you contact your GP before participating. We also recommend if you are pregnant that you do not participate in the event.

 

About the Foam

I understand:

  • The foam mixture is completely natural and safe. It is advisable that younger children wear swimming goggles or sunglasses, as they may be head deep at most bubble stations.
  • To be careful when wiping your eyes with my hands if they have frothy suds all over them too. Marshalls will have towels to help with this.
  • The coloured foam is made from food dye and is water soluble as well as environmentally friendly. There is a chance that this foam may stain some lighter coloured push chairs and clothes. It is advisable to bring towels to sit on in the car on your journey home – to avoid any possible stains.
  • If you have any skin conditions, we would recommend you speak to your GP before participating.
  • The bubble operators at each station are professionally trained and will not shoot foam directly at faces.
  • Demelza does not take any responsibility for any damage to any clothing or items belonging to the participants. Participants take part at their own risk.

 

What should I wear?

  • I have been advised to wear appropriate footwear to this event to ensure my safety when participating.

 

I understand that:

  • Due to the nature of the dyes used in the bubbles these may stain clothing. It is my responsibility to come suitably dressed for the event. The event organisers take no responsibility for colour stains on any shoes, clothing or any other belongings.
  • In order to protect my eyes while running through the foam stations I have been advised to wear protective sunglasses or goggles.
  • Participants can take part with a pushchair however I am aware that the route takes place on uneven ground and that the foam could stain the fabric, in some areas it is advised to carry children through the foam.
  • It is advised to bring a change of clothes and shoes, as well as a towel and that there are no changing facilities provided at the venue.

 

Cancellation & event amendments

  • Demelza reserves the right to cancel this event at any time. In the event of this happening, participants will be able to request a refund.
  • Demelza reserves the right to postpone this event at any time. In the event of this happening, Demelza will automatically transfer your booking to the postponed event and refunds are not guaranteed.
  • Demelza reserves the right to alter the start time of the event at any time.
